1. Acceptance of The Terms of Use
The terms of use stated hereunder are deemed agreed to by the subscriber or user with Cradle Haven Advisory Services (hereinafter referred to as “the company,” ‘We’) AND the subscriber or Customer as (‘customer’)
The following terms and conditions and the documents they expressly reference or attached to therein govern the Customer’s access to the use of https://cradlehaven/page/terms-andconditions, including any content, products, services offered on or through cradlehaven.com, social media, offline channel collectively the “Company”) and all other services, content, or applications link to these terms of use.
Applicants/subscribers are advised to read the terms of use and conditions cautiously before the commencement of the use of the Website or any of the services provided by the Company.
By using the Website of the Company or any of the affiliated services or products displayed or attached to therein, you agree to be bound and Abide by these terms of use and conditions and our privacy policy found at the privacy policy incorporated herein by reference.
If you do not want to agree with the terms of use and conditions of the Company or our privacy policy, you must not use or access any of our services.
The terms of use and conditions hereunder apply to all customers who have engaged the services of the Company pertaining to their travel needs unless otherwise stated.
Any amount of funds paid is for processing your application and providing advisory services and not for the guaranteed issuance of a Visa. Hence, there would not be any refund of funds paid after the completion of the application process.
Worthy of note is that ‘completion’ in this regard suggests that the customer’s/subscriber’s document and application have been submitted to the designated Embassy.
Worth noting is that Cradle Haven should not be liable in any form due to delays or changes to any application submitted, as the Company does not influence the response time at any Embassy.
Cradle Haven is not an agent of the Government of any country. Cradle Haven is an independent entity.
To the extent provided by law, the Company absolves itself, employees, and agents from liabilities of any kind, under any local laws/statutes, arising out of or in connection with your use, or inability to use, the Website, its services, any content on the Website, its social platforms, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CAN NOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW
All rates are fixed at the time of the booking and are subject to surcharges, especially during peak days, changes by embassies, or economic changes. There will also be an increase in our costs arising as the result of any government tax, new or increased taxes such as VAT (Value Added Tax).
We reserve the right to change our prices on the Website and other platforms at any time before you complete a paid booking or Service, including any special rates we may offer from time to time, which may not be the same as those published on this Website. * However, any changes in rates could be notified on the Website.
Cradle Haven’s Website and other social platforms may contain links to third-party sites promoting various products and/or services that Cradle Haven does not own or operate. These links to websites are in the form of paid advertising or other travel-related information and are not verified by Cradle Haven.
Links to websites not under the control of Cradle Haven, including those to our social media accounts, are permitted solely for the convenience of our Website visitors and other platform visitors. The Company does not guarantee the accuracy, currency, or reliability of the content of such websites and platforms. Cradle Haven does not offer any assurance in that regard, is not responsible for the information found through these links, and does not approve the sites and their content.
Access to these links is voluntary and does not indicate that Cradle Haven endorses it or is associated with any of these other third-party websites. Users are requested to use these links at their own discretion, risk, and cost when dealing with these websites, and neither Cradle Haven nor its officers, employees, or agents shall have any responsibility or liability of any nature whatsoever for these other third-party websites/links or any other information contained in them.
Cradle Haven does not accommodate/tolerate spam. Cradle Haven website/s or communication tools shall not be used to send spam or otherwise send content that would violate the terms and conditions of the Cradle Haven user agreement.

It is not permitted to license, add, modify, deface, hack, misuse, or abuse Cradle Haven’s Website or the contents therein.
Kindly take Notice of individuals misrepresenting themselves as Cradle Haven employees who have been known to approach customers or intending customers by creating a clone social media page, Website, and other means to extract payment from these customers to render false services.
On no occasion will customers be asked for a cash payment to be made or payment made to an individual private account other than one carrying the name “Cradle Haven Advisory Services.”
If you are aware of any such incidents, please report them to Cradle Haven at (contact@cradlehavven.com) as soon as possible.
Cradle Haven takes these matters extremely seriously and will notify local law enforcement to investigate and prosecute any illegal activities we are made aware of.
Under no circumstances will Cradle Haven be liable or responsible for any loss, damages, expenses, or inconvenience resulting from these unauthorized persons and/or activities or any Cradle Haven staff asking for money to be paid to their personal account.
The Company reserves the right and discretion to make revisions and update these Terms of Use from time to time. All changes made become effective immediately after it is posted or when they are communicated to you and apply to all access to and use of our services thereafter. However, any changes to the dispute resolution provisions set out in Governing Law and Jurisdiction will not apply to any disputes for which the parties have actual Notice before the date the change is posted on the Website.
Your continued use of our services following the posting of the revised Terms of Use means that you accept and agree to the changes. You are expected to check this page each time you access this Website so you are aware of any changes, as they are binding on you. It is your sole responsibility to ask any of our staff for the terms and conditions.
The Company reserves the right to update the content on this Website or other platforms owned by Cradle Haven from time to time, but its content is not necessarily complete or up to date. Any of the material on the Website and other platforms owned by Cradle Haven may be out of date at any given time, and we are under no obligation to update such material.
All information we collect on this website and other platforms is subject to our Privacy Policy] (https://haven/page/privacy-policy). By using the Website and other platforms, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.
No refund will be made with respect to Visa fees paid, accommodation, meals, sightseeing tours, medical appointments, reservations, visa applications, or any other services made available in the travel-related fare but not utilized by the Customer, either in part or whole or where the Customer amends, cancels or otherwise varies arrangements after the commencement of the travel related services.
Upon cancellation by the Company, the Company will refund the deposit paid according to the charges stipulated in section 2. All refunds made directly to Cradle Haven may take up to Ten (10) weeks to be paid, of which this clause is subject to the doctrine of force majeure.
To qualify for a refund of the fee paid, you must notify us in writing of your intention to withdraw the application. This must be received;
Within a maximum time of 48 hours after payment for Service before commencement of work (begins after 48 hours), the refund will attract a penalty of NGN20,000 deducted from the amount paid within the time frame stated above.
After 48 hours, there will be no room for a refund, but the intended Service can be postponed and used within a period of one (1) year from the initial date of payment.
NB: Visa fees and other payments made cannot be refunded if already paid for before the application is submitted. Also, should a refund for visa processing for any country or category be considered due to mutual agreement and termination, the Company will for instance, not refund professional visa processing fees and advisory services already commenced (however, 50% of the professional visa processing fees and advisory services may be refunded if not completed up to 50%), document vetting and compilation are (non-refundable at any stage), legal fees is (non-refundable at any stage), VAT and Tax are (non-refundable at any stage), visa fees is fully refunded if already paid the Company.Â
You shall ensure that you have a valid international passport with a minimum of 6 (six) months’ validity from the date of scheduled return to Nigeria and have at least 4 blank pages side by side. Prior to the scheduled departure date, you shall obtain the relevant valid visas and health certificates, which may be required at the destinations of travel in the tour/medical itinerary.
Different embassies/consulates require varying lengths of time to process visa applications. However, it is the passenger’s/client’s SOLE responsibility to ensure that he/she has a valid visa for travel to countries that require it, regardless of whether the Company was engaged to apply for the Visa. Please check with our office regarding your visa requirement before your intended trip to ensure the visa requirement is fulfilled. The Company will not be responsible for any expenses, reimbursement, or refund of any tour fare/medical trip schedule if the passenger’s visa process is refused or such a passenger is deported or refused entry by Immigration Authorities on the tour/medical trip for whatever reasons, including improper travel documents, quarantine, custom regulations, and possession of unlawful items or irregularities that may cause harm/damage to person or property.
Passengers are solely responsible for ensuring that they have all their valid travel documents (passport, Visa, etc.).
Customers who wish to interact with us on social media and other platforms are directed to read the terms and conditions for doing so. You should also read the terms of Service and the privacy policies of the social media platform provider and those of any applications you use to access that platform. Cradle Haven is an advisory company that acts as an agent for hospitals, accommodation, institutions, and other principals of third-party suppliers.
Cradle Haven acts solely as agents for the client/traveler with respect to all hospitals, hotels, and other travel-related arrangements. In that capacity, Cradle Haven exercises all reasonable care possible to ensure the traveler’s satisfaction and safety, but Cradle Haven neither assumes nor bears any responsibility or liability for any injury, death, damage, loss, accident, delay, or irregularity arising in connection with the services of any airplane, train, ship, automobile, motor coach, carriage, or other conveyance, or the actions of any third-party involved in carrying the traveler or in affecting these tours. Cradle Haven will not be held liable for visa rejection, delayed response from the Embassy, no response at all, or negligence due to misinformation provided by the client. Cradle Haven is not responsible for damages, additional expenses, or any other losses due to cancellation, delay, or other changes in air or other services, sickness, weather, strike, war, civil disturbances, acts or threats of terrorism, travel warnings or bans, termination or suspension of war risks or other carrier insurance, quarantine, acts of God or other causes beyond its control. All such losses must be borne by the traveler.
Cradle Haven is not responsible for delays, changes, or cancellation costs due to incorrect, incomplete, or expired traveler documents. In the event of cancellation, delay, or rescheduling mandated by any of the aforesaid causes beyond Cradle Haven’s control, the passenger shall have the option of accepting in lieu of the original tour such rescheduled tour or other substituted tour(s) as may be offered, or else, receiving a refund of as much of such advance tour expenditures as Cradle Haven may recover on the traveler’s behalf from carriers, third-party tour vendors, etc., but, Cradle Haven shall not have any obligation or liability to the traveler beyond the foregoing. Cradle Haven reserves the right to make alterations to a tour’s itinerary and to substitute hospitals, institutions, hotels, vehicles, ships, or activities if these are required.
You may choose to create an account with www.cradlehavven.com and provide certain data. In consideration of Cradle Haven permitting you to use the site, in providing such data, you represent and warrant that the information about yourself is true, accurate, current, and complete. You are responsible for maintaining the confidentiality of the password and user ID of your account and are fully responsible for all activities that occur under your password or user ID. Your account is for your use only. You may not permit others to use your passwords. You agree to:
- Immediately notify Cradle Haven of any unauthorized use of your password or account or any other breach of security.
- Ensure that you exit from your account at the end of each session. Cradle Haven cannot and will not be liable for any loss or damage arising from your failure to comply with this requirement.
The Company will read comments and private messages and participate in discussions when appropriate and required. Your comments and contributions must always be relevant and courteous.
The Company will not engage in partisan or political issues or respond to questions that violate these Terms and Conditions.
The Company reserves the right to remove comments, followers, and contributions and to block users based on the following criteria:
Infringe upon intellectual property or proprietary rights are racist, hateful, sexist, homophobic, or defamatory, or contain any inappropriate content targeted at ruining the Company’s image are threatening, violent, intimidating, or harassing are contrary to any federal or state laws of Nigeria constitute impersonation, advertising, or spam encourage or incite any criminal activity otherwise, violate this Notice.
The Company reserves the right to report users and/or their comments and contributions to third-party social media service providers to prevent or remove the posting of content that is contrary to these Terms and Conditions or to the Terms of Service/Use of the third-party social media platform.
We take our responsibilities regarding the protection of personal information very seriously. This policy explains how we use personal information that we may obtain about you. By using our Website and other channels, you consent to this use.

- details of your request and/or the information you want. Please be as specific as possible.
Gathering of Personally-Identifying Information:
Certain visitors to Cradle Haven’s Website choose to interact with Cradle Haven in ways that require Cradle Haven to gather personally-identifying information. The amount and type of information that Cradle Haven gathers depends on the nature of the Service. For example, we ask clients who wish to make use of one of our services to provide various documents, logins, and email addresses. For those who wish to receive Cradle Haven updates via email, we collect their emails. In each case, Cradle Haven accepts information supplied by the subscriber only when it is deemed necessary or appropriate to fulfill the purpose of the client’s interaction with Cradle Haven. Retention of Data:

Payments:

That information is provided directly to our third-party payment processors, whose use of your personal information is governed by their Privacy Policy.
Transmission of Payment Card Details Policy:

Cancellation and Changes Clause:
*All prices, including flights, visa fees, hospital bills, tuition, tours, accommodation, and other travel-related services, are subject to change without Notice. The right is reserved to hospitals, hotels, other travel-related services, change routing, or cancel any tour or portion thereof should conditions necessitate. However, any update from the third party regarding such changes as they permit may be hoisted on the platform if adequate Notice of such information is available.
All tours, cruises, and accommodation-inclusive packages are subject to specific cancellation charges, and we advise you to be fully aware of these and have adequate insurance to cover such eventualities. The tour operators reserve the right to cancel or change any tour or portion thereof if conditions so require. If a tour is canceled before the commencement of the tour, all monies will be refunded to the client. Prices may vary due to currency fluctuations or due to increase or decrease in taxes and government fees.
Privacy Policy Changes:
*Although changes to the content are not usually substantial, Cradle Haven may change its Privacy Policy from time to time, and it is Cradle Haven’s sole discretion, though such changes will not be a complete departure from its present privacy policy and are subject to privacy policy incorporated. Cradle Haven encourages clients to frequently check this page for any changes to its Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.

Cradle Haven also will not be held liable should there be any delays or changes in respect to any application submitted, as it does not influence the response time at any embassy.
You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of services, including, but not limited to any of the Website’s content, services, and products other than as expressly authorized in these Terms of Use or your use of any information obtained from the Website.
As a user of Cradle Haven services, I understand and agree that:

I understand that Cradle Haven provides only administrative assistance and advisory in the submission of applications and other services and that the Service is provided. I understand that Cradle Haven has no decision-making power or influence over visa applications or response timeframe by the Embassy.
Cradle Haven will receive documents from me and collect personal information related to me for the exclusive purpose of supporting the processing of my application and other travel related, including transferring such documents and information to and from various submission platforms.
My personal information may include my application form and supporting documents, photographs, and other biometric information, as required to complete any application. My personal information may also include information related to my application, identity, biographic, and contact details, including electronic records or data related to my application.
